PUBLIC NOTICE <br />Notice of this application was sent to all property owners and occupants within 1,000 feet <br />of the subject property. At the time this report was prepared, staffhad not received any <br />comments or concerns. <br />VALLEY BUSINESS PARK OWNERS' ASSOCIATION <br />Staff has yet to receive verbal or written input from Valley Business Park Owners' <br />Association regarding its position of the proposed use at this location. The applicant has <br />verbally stated to staff that the Business Park no longer provides such letters. Staff notes <br />that action on this application can be given by the Planning Commission without <br />approval from the Valley Business Park Owners' Association since the City does not <br />enforce CC&R's. <br />COMMUNITY CARE LICENSING DIVISION <br />Staff has been working with the State Department of Social Services-Community Care <br />Licensing Division (CCLD) to assess whether the martial arts facility requires State <br />licensing. Based on the information proved in Exhibit A, Tri-Valley Martial Arts <br />Academy is required to secure licensing with CCLD. Staff has confirmed with Susan <br />Boswell, Licensing Program Manager, that the applicant is in the process of obtaining a <br />child care license and the applicant has stated that he believes that he will satisfy the <br />requirements of CCLD and receive his childcare license no later than August. The <br />teacher/employee to children ratio shall be determined by the Department of Social <br />Services to ensure adequate supervision is provided. <br />Staff has added a condition of approval that the applicant shall provide staff with a copy <br />of the childcare license. <br />FINDINGS <br />The Planning Commission needs to make the following findings prior to granting the <br />conditional use permit for the proposed business: <br />1. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is <br />located. <br />Objectives of the Zoning Ordinance include: fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and ensuring that public and private lands ultimately <br />PCUP-229, Tri-Valley Martial Arts Academy Planning Commission <br />Page 10 of 12 <br />
