EXHIBIT B <br />DRAFT CONDITIONS OF APPROVAL <br />PAP-129 (PCUP-229), Tri-Valley Manual Arts Academy <br />1262 Quarry Lane, Suite A <br />January 6, 2009 <br />The location and operation of the proposed use shall conform substantially to <br />Exhibit A (site plan, floor plan, and written narrative), dated "Received, July 30, <br />2008," on file with the Planning Department, except as modified by the following <br />conditions of approval. Minor changes to the approved operation and schedule <br />may be approved by the Director of Community Development if found to be in <br />substantial compliance with the proposal. <br />2. All Conditions of Approval of PUD-80-1 shall remain in full force and effect. <br />3. All activities shall take place inside of the subject facility. <br />4. The operation of the activity center shall generally adhere to the following <br />schedule: <br />Kindergarten Program: Monday through Friday - 11:30 a.m. to 6:15 p.m.* <br />Middle School Program: Monday through Friday - 2:30 p.m. to 6:15 p.m.* <br />School Breaks and Holidays: Monday through Friday - 8:30 a.m. to 6:15 p.m.* <br />Evening Martial Arts Class: Monday through Friday - 6:45 p.m. to 9:00 p.m.** <br />* There shall be no more than 20 students ages 12 and under on site at any given <br />time. <br />** There shall be no more than 20 students ages 13 and older on site at any given time. <br />The facility shall not be open to the public on a drop-in basis. <br />Until such time that a daycare license is obtained, no child age 12 years and <br />under can participate at the facility for more than 16 hours per week or longer <br />than the 12-week period outlined in the private recreation exemption section <br />required by the State Child Care Licensing Division. The applicant shall meet all <br />requirements of the State for documentation, operations, student ratios, and all <br />other requirements of the Child Care Licensing Division. <br />No activities may be conducted beyond the hours noted in Condition of Approval <br />No. 4 above. The facility may remain open for transitioning between daytime and <br />evening classes and for a'/z-hour period before and after the hours of operation <br />in order for the facility to be cleaned and set up and for patrons to leave the <br />facility. <br />6. Overnight stays for any period of time shall not be permitted. <br />
