DRAFT <br /> <br /> AGREEMENT BY AND BETWEEN <br /> THE PLEASANTON DOWNTOWN ASSOCIATION <br /> AND THE CITY OF PLEASANTON TO <br />ADMINISTER THE DOWNTOWN PLEASANTON BUSINESS <br />IMPROVEMENT DISTRICT <br /> <br /> THIS AGREEMENT, made and entered into this 8th day of December. 1999, by <br />and between the CITY OF PLEASANTON, a municipal corporation (hereinaf~er "City"), <br />and the PLEASANTON DOWNTOWN ASSOCIATION, a non-profit corporation <br />(hereinafter "Association"); <br /> <br />WITNESSETH: <br /> <br />The parties hereto do agree as follows: <br /> <br />(1) RECITALS. This agreement is made and entered into with respect to the <br />following facts: <br /> <br />(a) The Pleasanton City Council has established the Downtown <br />Pleasanton Business Improvement District (hereinai~er "District"), pursuant <br />to Section 36000 et seq. of the Streets and Highways Code of the State of <br />California, by the adoption of Ordinance No. 1110 on December 6, 1983, as <br />amended from time to time, and codi~ed in Chapter 5.28 of the Pleasanton <br />Municipal Code. <br /> <br />(b) The City and the Association wish to contract for the Association to <br />administer the Downtown Pleasanton Business Improvement District on <br />behalf of the City. <br /> <br />(c) All persons engaged in business within the District are members of <br />said Association. <br /> <br />(d) Pursuant to said Ordinance a charge will be imposed on all <br />businesses located within the District. -- -- <br /> <br />(e) The charges as levied are to be utilized exclusively for the purposes <br />as set forth in said Ordinance. <br /> <br />(f) The Association has as, one of its primary purposes, the promotion <br />of businesses located within the District. <br /> <br />(agt~mcnt\dnmaso.sam) I <br /> <br /> <br />
