notice of assignment in each case upon such allocation. <br />4. Building Permit Limitation. The Court Orders <br />provide that the Sewer Permits are subject to the exclusive <br />control of the City. The Court Orders further provide that <br />a written agreement between a property owner and the City, <br />precluding the owner or its successor or assigns from <br />obtaining the necessary building permits for a specified <br />period of time tolls for that period of time, the three year <br />period for obtaining building permits. <br /> <br /> A. The Owner of Parcel 1 shall not be entitled <br /> <br />to obtain building permits during the term of this Amended <br />Agreemcnt except during the period~ and subject to the <br />limitations described below or upon the use or expiration of <br />all Parcel 1 Sewer Permits in accordance with Paragraph 5. <br />In each case, the reference to the number of Parcel 1 Sewer <br />Permits which may be used shall mean that Owner shall not be <br />entitled to obtain building permits which, based on the <br />sewer demand formula being generally applied by the City at <br />the time, shall require Sewer Permits in excess of the <br />number which may be used pursuant to this Paragraph. <br /> <br /> (1) Time Period for use of Parcel 1 Permits. <br /> Owner may use the number of Parcel 1 Sewer Permits in <br /> connection with construction of any buildings during <br /> the period commencing on the later of May 1, 1986 or a <br /> date Ninety (90) days after completion of the <br /> <br /> 10 <br /> <br /> <br />
