RESOLUTION NO. 08- <br />ATTACHMENT 1 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />UPHOLDING THE APPEAL OF JACOB REEVES, T- MOBILE, CASE PAP -128, <br />THEREBY OVERTURNING THE PLANNING COMMISSION'S DENIAL AND <br />UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL OF KELLY <br />PEPPER/TOWN CONSULTING ON BEHALF OF T- MOBILE FOR DESIGN REVEW, <br />AS FILED UNDER CASE PDRW -6 <br />WHEREAS, Kelly Pepper/Town Consulting, on behalf of T- Mobile, has applied for <br />design review approval to redesign the existing tower at the existing McDonald's building <br />located at 3001 Bernal Avenue to house a wireless facility for T- Mobile; and <br />WHEREAS, zoning for the property is PUD -C (Planned Unit Development <br />Commercial) District; and <br />WHEREAS, on September 2, 2008, the Zoning Administrator approved the <br />application for design review; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Phil Blank <br />appealed the Zoning Administrator's decision to the Planning Commission; and <br />WHEREAS, at its meeting of September 24, 2008, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City <br />staff concerning this application, upheld the appeal, thereby overturning the decision of the <br />Zoning Administrator; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Jacob <br />Reeves, T- Mobile, submitted an appeal to the City Council of the decision of the Planning <br />Commission; and <br />WHEREAS, at its meeting of December 16, 2008, the City Council received a <br />report from the Director of Community Development, together with a copy of the staff <br />report to the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on December 16, 2008, at <br />which time the appellant and any other member of the public were offered an <br />opportunity to present evidence regrading this appeal; and <br />WHEREAS, actions of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act (CEQA) Guidelines, <br />Section 15301, Class 1, "Existing Facilities and <br />
