THE CITY OF <br />CITY COUNCIL AGENDA REPORT <br />j~L£~S~4NTONe <br />December 16, 2008 <br />Community Development <br />Engineering Division <br />TITLE: APPROVAL OF CONTRACT AMENDMENT NO. 2 WITH KLEINFELDER <br />INC. IN THE NOT TO EXCEED AMOUNT OF $35,000 FOR CONSULTANT <br />ENVIRONMENTAL SERVICES FOR SOIL AND GROUNDWATER <br />SAMPLING FOR FIRE STATION NO. 3 <br />SUMMARY <br />The Alameda County Health Care Services (ACHCS) provides local regulatory oversight <br />of the investigation and cleanup of soil and groundwater contamination from leaking <br />petroleum underground storage tanks. The City has been working with the ACHCS and <br />Kleinfelder, Inc., to process the final inspection of two 500 gallon capacity underground <br />storage tank systems (gasoline and diesel fuel) that were removed from 4444 Railroad <br />Avenue (the site of the new Firehouse Arts Center) and two additional underground fuel <br />tanks that were removed from 3200 Santa Rita Road (Fire Station No. 3) in 1996. The <br />ACHCS has approved (closed out) the tank removals site at 4444 Railroad Avenue and <br />no additional work is necessary. However, the ACHCS has determined that additional <br />work will be required to further investigate the site located at 3200 Santa Rita Road, as <br />soil samples indicate the presence of petroleum hydrocarbons. Staff is proposing an <br />amendment to evaluate existing conditions as required by the ACHCS. <br />STAFF RECOMMENDATION: <br />1. Authorize the City Manager to approve Contract Amendment No. 2, in an amount <br />not to exceed $35,000, to the professional services agreement with Kleinfelder, <br />Inc. of Pleasanton, California (Attachment 1). <br />2. Authorize the Director of Community Development to approve and execute <br />contract change orders for a contingency amount not-to-exceed $7,000 (20% of <br />the contract amendment amount), for necessary related project work for a total <br />potential contract value of $42,000. <br />3. Authorize funding from the General Fund Contingency Reserve in the amount of <br />$42,000 for the subject project. <br />FINANCIAL IMPACT <br />The proposal submitted by Kleinfelder, Inc. is an estimate for determining the horizontal <br />and vertical extent of the petroleum hydrocarbons found at the site. Once the limits of <br />the petroleum hydrocarbons are confirmed, a remediation plan will be developed and <br />implemented. The cost of the remediation plan and associated mitigation efforts are not <br />part of this amendment and will be negotiated once the conditions have been fully <br />assessed. <br />
