AND WHEREAS, this Board of Supervisors does and it hereby finds and determines that the public highway use of said lands, as proposed by the City of Pleasanton will not substantially conflict or interfere with the Alameda County Flood Control and Water Conservation District's use thereof; 'NOW, THEREFORE, BE IT RESOLVED, that the request of the City of Pleasanton be and the'same is hereby approved, and the Chairman of this Board of Supervisors be and he is hereby authorized and directed to execute, on behalf of the Alameda County Flood Control and Water Conservation District, under the authority of Section 25526.6 of the Government Code of the State of California, a Grant of Right of Way conveying unto the City of Pleasanton, a municipal corporation, a perpetual right of way and easement for public highway purposes and appurtenances thereto, over, upon and across the hereinabove described real property; and BE IT FURTHER RESOLVED, that said perpetual right of way and easement is granted upon the following terms and conditions, to wit: 1. There is no charge for the property rights conveyed. 2. Alameda County Flood Control and Water Conservation District is held harmless from damages or claims for damages proximately arising from'the public highway use of the hereinabove described real property. 3. The construction, operation, maintenance, repair and replacement of the public highway and structures and installations appurtenant thereto, upon the aforesaid real property, is the sole responsibility of the City of Pleasanton. 4. The operation, maintenance, repair and clearin~ of the stream channel and bank areas is the responsibility of the Alameda County Flood Control and Water Conservation District, its successors and assigns. AND BE IT FURTHER RESOLVED, that the City of Pleasanton's acceptance of the Grant of Right of Way herein authorized shall constitute acceptance of the terms and conditions hereinabove set forth.
