7. Sewer capacity purchased through this program <br /> cannot be connected to the City sewer system until <br /> the current LAVWMA and the DSRSD expansion projects <br /> are completed and satisfactorily operating. <br /> <br />PROCEDURES TO PURCHASE <br /> <br /> 1. Applications to purchase sewer capacity under this <br /> program must be received by the City Manager's <br /> office by 5:00 p.m., November 22, 1985. <br /> <br /> 2. All qualified applicants will be sold capacity <br /> applied for provided applications do not exceed <br /> 300,000 GPD total capacity. <br /> <br /> 3. If applications received exceed 300,000 GPD, each <br /> qualified applicant will be entitled to purchase a <br /> pro rata share of the 300,000 GPD to be sold. <br /> <br /> 4. The purchase price for capacity purchase~ 'under <br /> this program is $2,500.00 for each Residential <br /> Dwelling Equivalent (RDE) or 220 GPD. <br /> <br /> 5. Successful applicants must submit a check for the <br /> amount of sewer capacity qualified to purchase <br /> within ten (10) days of written notice by the City <br /> Manager. <br /> <br />BUY BACK OF CAPACITY <br /> <br /> 1. City ma~ buy back the capacity, if offered by the <br /> purchaser, at any time if it would be advantageous <br /> to the City. <br /> <br /> 2. City will buy back the capacity at the price paid, <br /> if requested by the purchaser, two years after the <br /> LAVWMA and the DSRSD expansion projects are <br /> operating satisfactorily, provided funds are <br /> available in the expansion fund. <br /> <br /> 3. City Fay buy back at its sole discretion, at the <br /> price paid plus seven percent simple interest three <br /> (3) years after the LAVWMA and the DSRSD expansion <br /> projects are operating satisfactorily, any capacity <br /> for which building permits have not been taken out. <br /> <br /> - 2 - <br /> <br /> <br />
