The Council has made it quite clear that the
purchaser of any of this advance sale capacity would not receive guarantees
or special consideration for future approval of projects or growth
management approval. The restrictions and buy back procedures were
included in the legal notice attached.

It should be pointed out that this capacity cannot be connected to the
system until both expansion projects are completed and satisfactorily
operating, which is not expected until late 1987. Although the City may
buy back the capacity, a purchaser may have to hold the capacity for an
indefinite period of time without the ability to connect to the system.
The City also has the right, under the condition of the sale, to buy back
the capacity three years after the two expansion projects are completed, if
building permits have not been taken out.

A permit has been prepared (copy attached) which includes the conditions
under which the capacity will be purchased. The purchaser would be
required to sign the permit.

Page 3
SR85:611
