CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-580 <br /> <br /> RESOLUTION VACATING PORTION OF OWENS DRIVE, ACCEPTING <br /> GRANT DEEDS FROM DELTA PROPERTIES AND AUTHORIZING DEEDS <br /> FROM THE CITY OF PLEASANTON TO C & H DEVELOPMENT CO. AND <br /> FROM THE CITY OF PLEASANTON TO CHRISTOPOLOUS ET AL. <br /> <br />WHEREAS, on December 17, 1985, the City Council received a staff <br /> report recommending the vacation of a portion of Owens <br /> Drive, more particularly described in Exhibit A, <br /> attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, the proposed vacation of a portion of Owens Drive is <br /> consistent with the goals and policies of the General <br /> Plan; and <br /> <br />WHEREAS, that portion of Owens Drive is no longer necessary for <br /> present or prospective street purposes; and <br /> <br />WHEREAS, the City is in receipt of two Grant Deeds from Delta <br /> Properties to the City of Pleasanton, copies of which <br /> are attached hereto and incorporated herein by this <br /> reference, for purposes of property transfers called for <br /> in the stipulated agreement settling an action in <br /> eminent domain; and <br /> <br />WHEREAS, pursuant'to the above-referenced settlement agreement, <br /> the City shall, in turn, transfer the property acquired <br /> from Delta Properties to C & H Development Co. and to <br /> Constantine Christopolous, et al. and shall transfer the <br /> vacated parcel to C & H Development Co.; and <br /> <br />WHEREAS, the City Council has reviewed the report from the City <br /> Attorney indicating the acceptance of the deeds from <br /> Delta Properties and execution of the above deeds are in <br /> the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby declares that portion of <br /> Owens Drive as described on the attached Exhibit A as <br /> excess right-of-way. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> excess right-of-way on Owens Drive in a manner meeting <br /> the requirements of Section 8334 of the Streets and <br /> Highways Code, that portion of Owens Drive described in <br /> Exhibit A is hereby vacated. <br /> <br /> <br />
