As to the <br />Neigh m an rear yar ae c an pan ng requirements, set <br />forth in paragraphs 17 and 21 of Exhibit "B" hereto, the owners <br />of lots 25 through 30, 46 through 49 and 53 of Tract 3328 shall <br />be considered third party beneficiaries and, as such, entitled to <br />enforce the provisions thereof. <br />Section 26. Maintenance. Each owner of a lot shall be <br />reepona a or ma n a n ng a structures located upon his lot, <br />including the equipment and fixtures in the structure and its <br />walls, roof, ceilings, windows and doors in a clean, sanitary, <br />workable and attractive condition. However, each owner has <br />complete discretion as to the choice of furniture, furnishings, <br />and interior decorating; except that windows can be covered only <br />by drapes, shutters, or shades and cannot be painted or covered <br />by foil, cardboard, or other similar materials. Each owner also <br />shall be responsible for maintenance, repair „ and repiacement of <br />all plumbing, electrical, heating, air-conditioning, and gas <br />lines, conduits, apparatus, and equipment servicing his lot and <br />repair, repiacement, and cleaning of the windows and glass of hie <br />or her structure. If an owner is required to make any repair or <br />if the owner desires to construct any improvement or install any <br />fixture or equipment that will affect or involve any bearing wall <br />or other structural member, the prior written approval of the <br />Architectural Committee must first be obtained. However,-such <br />approval need not be obtained to make emergency repairs, provided <br />that the structure so affected is restored to its original <br />condition at the owner's expense. <br />Section 27. Oil Drillin No oil drilling, oil development <br />opera one, o re n ng, quarrying, or mining operations of any <br />kind shall be permitted on or in the Projects and no oil sells, <br />tanks, tunnels or minernl excavations or shafts shall be <br />permitted on the surface of the Project or within five hundred <br />(500) feet below the surface of the Project. No derrick or other <br />structure designed for use in boring for water, oil, or natural <br />gas shall be erected, maintafneA, or permitted on the Project. <br />7 <br />
