Breach - Mortgage Prot_ec_tion. The breach o! <br />any rei~iTc ons, covansn s or agreements con aimed-herein shall <br />not defeat or affect the lien of any mortgage or deed of trust <br />made in good faith for value upon said lands but the breach of <br />any restrictions, covenants or agreements may be enjoined, abated <br />or remitted by appropriate proceedings as otherwise provided for <br />herein, notwithstanding the lien oz existence of such deed of <br />trust or mortgage. Notwithstanding the foregoing, each and. every <br />restriction, covenant and agreement contained herein shall remain <br />in full force and effect as agninet, and shall be binding upon, <br />and shall be a part of, the estate acquired by anyone, and the <br />heirs, administrators, executors, successors, devisees, and <br />assigns of anyone acquiring title under or through any such deed <br />of trust or mortgage. <br />Section 20. Benefit. These restrictions, covenants and <br />agreenen • con orm o e intention of the Declarant to create a <br />uniform plan covering the real property herein describeds an8 it <br />is further expressly declared that said restrictions, covenants <br />and agreements are for the benefit of the lands so described and <br />are ezpressly made for and to owners, their heirs, successors and <br />assigns, and that said restrictions, covenants and agreements run <br />with the land described and referred to herein. <br />Section 21. Remedies. The result of every sat or omission <br />where any con tons, covenants, restrictions or reservations <br />herein contained are violated in whole oz in part, is hereby <br />declared to be and constitutes nuisance and every remedy allowed <br />by law or equity against an owner, either public or private, <br />shall be applicable against every such result and mey be. <br />exercised by Declarant, the Architectural Committee or the owner <br />or owners of any lot. The covenants, conditions and restrictions <br />contained herein are specifically enlorceable, and any omission <br />to act by any owner, bound herein, is subject to mandatory <br />injunction to compel compliance. In any legal or equitable <br />proceeding for the enforcement of or to restrain the violation of <br />this Declaration or any provisions hereof, the losing party or <br />psrties shall pay court costs and Legal fee• in such amount as <br />may be fixed by the court in such proceeding. Such remedies <br />shall be deemed cumulative and not exclusive. <br />Section 22. Waiver. waiver of the enforcement of any of <br />the res r c one, covenants and agreements herein contained in <br />any instance shall not constitute a waiver to enforce any of sai8 <br />restrictions, covenants or agreements thereafter. <br />Section 23.
