11.04.85 <br />P129-019 <br />realestl-370 C '~' <br /> <br />EXHIBIT C ("Parcel C") for the specific purpose of releasing <br />any and all road and highway easement or rights of way <br />previously granted to the City and Warren or Prudential, as the <br />case may be, shall accept such conveyance. The City reserves <br />the utility easements, including any rights held by the Alameda <br />County Flood Control and Water Conservation District and the <br />PSE (described in Section 1.4) in Parcel C. If the City <br />quitclaims any portion of Parcel C to Prudential, Prudential <br />shall quitclaim same to Warren at the close of escrow. <br /> <br /> 1.4 Warren Grant of PSE in Parcel D to City. Warren <br />shall convey to the City an easement along Owens Drive and <br />Owens Court as shown on EXHIBIT D ("Parcel D") for the purpose <br />of installing and maintaining water, gas, electric, telephone <br /> <br />and other publ'ic services. The City shall accept such <br />conveyance. Such easement shall hereafter be called the "PSE". <br />In installing and maintaining the utility facilities, <br /> <br />the City shall exercise reasonable care to avoid damage to the <br />property adjacent to Parcel D and to all improvements and <br />landscaping that may be located thereon; and perform all work <br />in a timely manner so as not to unreasonably interfere with <br />Warren's use of Parcel D and any easements therein. <br /> <br /> 1.5 Warren Grant of Landscape Easement in Parcel F to <br />Hacienda. Subject to the PSE described in Section 1.4, Warren <br />shall convey to Hacienda~nonexclusive easement~ ("Landscape <br />Easement") as shown and described on EXHIBIT F ("Parcel F") for <br />the purpose of installing and maintaining landscaping and signs <br /> <br /> -4- <br /> <br /> <br />
