AGREEMENT FOR DESIGN AND CONSTRUCTION <br /> SERVICES BETWEEN THE CITY OF PLEASANTON <br /> AND DE LEUW, CATHER & COMPANY <br /> FOR <br /> PROPOSED VALLEY AVENUE RAILROAD GRADE SEPARATION <br /> AT THE <br /> UNION PACIFIC AND SOUTHERN PACIFIC RAILROADS <br /> IN PLEASANTON <br /> <br />PARTIES: <br /> <br /> This Agreement is entered into this day of November, <br />1985, between the CITY OF PLEASANTON, a Municipal Corporation of the <br />State of California, hereinafter called "City," and DE LEUW, CATHER & <br />COMPANY, an Illinois Corporation having a place of business at 120 <br />Howard Street, San Francisco, California, hereinafter called "Engineer." <br /> <br /> WITNESSETH <br /> <br />WHEREAS, City desires preparation of final design plans, specifications, <br />and cost estimates for a proposed Valley Avenue Grade Separation under <br />the single-track mainline of the Union Pacific Railroad (formerly <br />Western Pacific Railroad) and the tail track of the Southern Pacific <br />Transportation Company in Pleasanton (herein called "Project"); and <br /> <br />WHEREAS, Engineer is qualified and licensed to perform the professional <br />engineering services required under the terms of this Agreement, and <br />hereby agrees to perform such services in accordance with the terms and <br />conditions stated hereinafter. <br /> <br />NOW, THEREFORE, it is agreed by the parties hereto as follows: <br /> <br />A. ENGINEER'S SCOPE OF SERVICES <br /> <br />The Engineer shall be responsible for the following listed activities <br />and services: <br /> <br />DESIGN <br /> <br /> 1. Maintain liaison with Railroads, in an effort to expedite <br />railroad trackwork, technical reviews, and other work performed by <br />rai]road forces. Consult with Railroads with respect to location of <br />piers and footings on railroad property and/or adjacent to railroad <br />tracks, shooflys, maintaining rail traffic during construction, and <br />other design requirements. <br /> <br /> 2. Assist the City in preparing and expediting the Request to <br />Modify Decision before the PUC to allow construction of the underpass <br />structure instead of the approved at-grade crossing. <br /> <br /> <br />
