C. The overhead facilities to be removed and the Electric Facilities to be <br /> installed are to be constructed by PGandE. <br /> <br /> D. The ownership of the Electric Facilities, Electric Relocation Facilities <br /> <br /> and a portion of the Street Lighting Service Facilities shall vest in PGandE, as <br /> authorized by the provisions of Sections 5896.9, lOlO9, lOllO and lOlll of the <br /> Streets and Highways Code of the State of California. <br /> <br /> NOW, THEREFORE, IT IS MUTALLY AGREED AS FOLLOWS: <br /> <br /> 1. City shall pay to PGandE upon demand, and prior to any construction by <br /> PGandE, the nonrefundable amount of $25,392 which represents PGandE's cost to perform <br /> the trenching, excavating and backfilling for the electric facilities and <br /> substructures. <br /> <br /> 2. City shall pay to PGandE upon demand, and prior to any.cOnstruction by <br />PGandE, the nonrefundable amount of $1,976 which represents PGandE's cost to <br />temporarily raise low voltage cables on poles to enable Pacific Bell to raise its <br />cables to provide construction ground clearance. <br /> <br /> 3. City shall pay to PGandE upon demand,~and prior to any construction by <br />PGandE, the nonrefundable amount of $128,652 which represents PGandE's cost to <br />relocate existing underground Electric Relocation Facilities to accommodate the <br />street widening of Johnson Industrial Drive and the widening of the intersection of <br />Johnson Industrial Drive and Stoneridge Dr~ve. <br /> <br /> 4. City shall pay to PGandE upon demand, and prior to any construction by <br />PGandE, the amount of S6,244 which represents the temporary work by PGandE which has <br />been necessitated by the unavailabilit9 of a rights of way to be granted by the <br />United States Department of the Army.
