CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-464 <br /> <br /> RESOLUTION RESCINDING RESOLUTION NO. 85-213 AND VACATING <br /> PORTIONS OF HOPYARD ROAD NEAR WEST LAS POSITAS BOULEVARD <br /> <br />WHEREAS, on May 7, 1985, the City Council adopted Resolution No. <br /> 85-213 vacating portions of Hopyard Road near West Las <br /> Positas Boulevard and portions of the public service <br /> easements adjacent thereto, as generally described in <br /> the attached exhibits to staff report SR 85:213; and <br /> <br />WHEREAS, subsequent to that action, the City has reconsidered and <br /> wishes to now vacate only a portion of the area <br /> previously vacated; and <br /> <br />WHEREAS, the proposed vacation of a portion of Hopyard Road and <br /> the public service easements is consistent with the <br /> goals and policies of the General Plan; and <br /> <br />WHEREAS, the excess right-of-way of Hopyard Road is no longer <br /> necessary for present or prospective public street <br /> purposes; and <br /> <br />WHEREAS, the public service easements proposed for vacation <br /> contain no public facilities, have not been continuously <br /> used since their dedication, would be superseded by <br /> relocation to the area of the vacated portion of Hopyard <br /> Road, above, and were dedicated between one and five <br /> years preceding the vacation; and <br /> <br />WHEREAS, there are in place public service facilities within the <br /> area of Hopyard Road to be vacated which are in use, and <br /> public convenience and necessity require the reservation <br /> of easements for these facilities; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> excess rights-of-way of Hopyard Road in a manner meeting <br /> the requirements of Section 8334 of the Streets and <br /> Highways Code, those portions of Hopyard Road described <br /> in Exhibit "A" are hereby vacated. <br /> <br />Section 2. Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> necessity to vacate the public service easements in a <br /> manner meeting the requirements of Section 8333(b) and <br /> (c) of the Streets and Highway Code, those portions of <br /> <br /> <br />
