ROLL CALL VOTE: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Wood and <br /> Mayor Mercer <br /> NOES:None <br /> ABSENT:None <br /> <br />Section 4: Approves the application of John Payne, et al. to <br /> amend the Land Use Element designation of the General <br /> Plan for an approximately 2.6 acre site located at 4089 <br /> and 4129 Stanley Boulevard, subject to the the following <br /> conditions: <br /> <br /> 1. That no building permit for any High Density <br /> project be issued until the Del Valle Parkway <br /> alignment has been set. <br /> <br /> 2. That no building permit for any High Density <br /> project shall be issued until the contract for the <br /> construction of the Valley Avenue extension to <br /> Stanley Boulevard is let. In the event such <br /> contract cannot be let by May 6, 1986, developers <br /> of property subject to this condition may propose <br /> an interim engineering measure to mitigate the <br /> short-term impacts of a project on existing Stanley <br /> Boulevard. Council approval of such engineering <br /> measure shall be deemed to be compliance with this <br /> condition. <br /> <br /> 3. That for any development other than single-family <br /> detached development the minimum lot width shall be <br /> 120 ft. and the lot shall have a depth no more than <br /> three times as deep as it is wide. <br /> <br /> 4. That driveways off of Del Valle Parkway shall be <br /> minimized through use of common driveways and/or <br /> reciprocal access easements over and between <br /> adjacent properties. <br /> <br /> 5. That the minimum front setback for any structure, <br /> including enclosed patio fences, other than an <br /> existing residence shall be thirty feet from the <br /> Del Valle Parkway right-of-way. <br /> <br /> 6. That minimum setbacks from any part of a residence <br /> existing at the time of this General Plan change <br /> shall be thirty feet. <br /> <br /> 7. That second story decks and/or second story windows <br /> be set back a minimum 15 feet from the Property <br /> line of every lot containing a residence existing <br /> at the time of this General Plan change. <br /> <br /> 8. That the base density for the subject are be 12 <br /> DU/net acre, with density allowed to reach 15 <br /> DU/net acre if the project (1) is an apartment <br /> complex with units available for lower-income <br /> <br /> <br />
