ATTACHMENTI MEMORANDUM OF UNDERSTANDING BETWEEN ALAMEDA COUNTY CONGESTION MANAGEMENT AGENCY AND CITY OF PLEASANTON Relative to: Construction of I-580 HOV Lanes: Tassajara Road to Vasco Road This MEMORANDUM OF UNDERSTANDING ("MOU") is entered into as of November 4, 2008, by and between the City of Pleasanton, ("PLEASANTON") and the Alameda County Congestion Management Agency ("CMA"). RECITALS A. WHEREAS, PLEASANTON, as one of the members of the Tri-Valley Transportation Council ("TVTC"), is a signatory to the Joint Exercise of Powers Agreement Pertaining to the Tri-Valley Transportation Development Fee (TVTDF) for Traffic Mitigation; and B. WHEREAS, the Tri-Valley Transportation Development Fees aze divided into the "Eighty Percent Fees" which aze allocated by TVTC to projects in the TVTDF Funding Plan, and the "Twenty Percent Fees," a portion of which are available to PLEASANTON for allocation to projects at its discretion; and C. WHEREAS, the TVTC has identified the PROJECT as one of eleven projects which it proposes to fund in part with the "Eighty Percent Fees" portion of the developer fees; and D. WHEREAS, the PROJECT is to be funded with $173.9 million in State Congestion Management Improvement Account (CMIA) funds, $25 million in State Traffic Congestion Relief Program (TCRP) funds, $17.7 million in State Transportation Improvement (STIP) funds, $27 million in State SHOPP funds, $15.6 million in Federal TEA-LU funds, and the balance in local contributions comprising MTC RM-2, TVTDF, and ACTIA funds; and E. WHEREAS, the CMA is sponsoring the PROJECT as a series of staged corridor improvements focused on the construction of HOV lanes on Interstate 580 in accordance with the adopted 2004 TVTC Strategic Plan; and F. WHEREAS, the CMA is sponsoring and has obtained environmental cleazance for the eastbound stage of the PROJECT in November 2007 and is currently proceeding with construction; and
