4 <br />THE CITY OF <br />CITY COUNCIL AGENDA REPORT <br />j~L£~S~4NTONe <br />November 4, 2008 <br />Community Development <br />Engineering Division <br />TITLE: APPROVAL OF MEMORANDUM OF UNDERSTANDING BETWEEN THE <br />CITY OF PLEASANTON AND THE ALAMEDA COUNTY CONGESTION <br />MANAGEMENT AGENCY FOR THE EXPENDITURE OF TRI-VALLEY <br />TRANSPORTATION FUNDS ON THE I-580 HIGH OCCUPANCY VEHICLE <br />LANE PROJECT <br />SUMMARY <br />The City of Pleasanton is identified in the Tri-Valley Transportation Council's (MC) <br />Strategic Expenditure Plan (SEP) as the lead agency on the I-580 High Occupancy <br />Vehicle (HOV) Lane project. The SEP requires that MC funds for projects be <br />allocated directly to the lead agency identified in the plan for expenditure. However, <br />the Alameda County Congestion Management Agency (ACCMA) will be the lead <br />agency in administering the I-580 HOV Lane Project contract and responsible for <br />payment to Caltrans. Because the City of Pleasanton is required to receive the MC <br />funds, but the ACCMA will actually administer the project, there needs to be an <br />agreement to allow Pleasanton to pass the TVTC funds to ACCMA to administer the <br />project. The attached Memorandum of Understanding outlines the agreement between <br />the City of Pleasanton and the ACCMA for the request and expenditure of the $8 million <br />in MC funds for specific use on the I-580 HOV Lane Project. <br />;,OMMENDATION <br />1. Approve the attached Memorandum of Understanding (Attachment 1) between <br />the City of Pleasanton and the Alameda County Congestion Management <br />Agency for the allocation and disbursement of $8 million in Tri-Valley <br />Transportation Council Development Fee funds for the I-580 High Occupancy <br />Vehicle Lane Project. <br />2. Authorize the Mayor to execute the attached Memorandum of Understanding. <br />FINANCIAL STATEMENT <br />There are no local funds included in this Memorandum of Understanding. The City of <br />Pleasanton will act as the pass-through agency, collecting the funds from the TVTC <br />treasurer, then forwarding the collected funds to the ACCMA. There is no financial <br />impact as a result of this Memorandum of Understanding. <br />
