3 <br />THE CITY OF <br />-~- ~"' CITY COUNCIL AGENDA REPORT <br />PL~~S~NTONo <br />October 21, 2008 <br />Community Development <br />Engineering Division <br />TITLE: APPROVAL OF PLANS AND SPECIFICATIONS, REVIEW OF BIDS, AND <br />AWARD OF CONSTRUCTION CONTRACT TO MCGUIRE AND RESTER IN <br />THE AMOUNT OF $454,855 FOR THE MARILYN MURPHY KANE TRAIL, <br />CIP NO. 087032 <br />SUMMARY <br />Plans and specifications were prepared for the subject project. Bids have been <br />received and staff is recommending award of the construction contract to the lowest <br />responsible bidder, McGuire and Hester in the amount of $454,855. The subject <br />project consists of constructing amulti-purpose trail along the east side of the Arroyo de <br />la Laguna between Bernal Avenue and the northern limit of Castlewood Country Club, <br />including three vista points and other related appurtenances. <br />RECOMMENDATION <br />1. Approve the plans and specifications for the subject project. <br />2. Review the bids received and award the construction contract to McGuire and <br />Hester of Oakland, for a low bid amount of $454,855. <br />3. Authorize the City Manager to enter into the above construction contract. <br />4. Authorize the Director of Community Development to approve and execute <br />contract change orders for a contingency amount not to exceed $90,971 (20% of <br />the construction contract), if necessary, for related subject project work. <br />5. Authorize the transfer of $152,000 from CIP No. 047021, Bernal Property Trail <br />Reserve, to CIP No. 087032, Marilyn Murphy Kane Trail, to augment the $500,000 <br />donation made by the Kane Family. <br />FINANCIAL STATEMENT <br />This project will extend the multi-purpose trail constructed several years ago as part of <br />the Bernal Creek Restoration Project, northerly up to the vicinity of Bernal Avenue. <br />Once completed, the Parks Maintenance Division will incur additional costs in <br />maintaining the project. The Kane Family of Pleasanton donated $500,000 in March, <br />2008 for construction of this trail. They have verbally pledged to contribute additional <br />funds at some point in the future. Since the City had previously set aside $200,000 for <br />construction of temporary trails on the Bernal Property that are not being constructed <br />(CIP No. 047021), staff recommends utilizing $152,000 of these funds to augment the <br />existing donation so that the trail can be constructed immediately. <br />
