3 THE CITY OF -~- ~"' CITY COUNCIL AGENDA REPORT PL~~S~NTONo October 21, 2008 Community Development Engineering Division TITLE: APPROVAL OF PLANS AND SPECIFICATIONS, REVIEW OF BIDS, AND AWARD OF CONSTRUCTION CONTRACT TO MCGUIRE AND RESTER IN THE AMOUNT OF $454,855 FOR THE MARILYN MURPHY KANE TRAIL, CIP NO. 087032 SUMMARY Plans and specifications were prepared for the subject project. Bids have been received and staff is recommending award of the construction contract to the lowest responsible bidder, McGuire and Hester in the amount of $454,855. The subject project consists of constructing amulti-purpose trail along the east side of the Arroyo de la Laguna between Bernal Avenue and the northern limit of Castlewood Country Club, including three vista points and other related appurtenances. RECOMMENDATION 1. Approve the plans and specifications for the subject project. 2. Review the bids received and award the construction contract to McGuire and Hester of Oakland, for a low bid amount of $454,855. 3. Authorize the City Manager to enter into the above construction contract. 4. Authorize the Director of Community Development to approve and execute contract change orders for a contingency amount not to exceed $90,971 (20% of the construction contract), if necessary, for related subject project work. 5. Authorize the transfer of $152,000 from CIP No. 047021, Bernal Property Trail Reserve, to CIP No. 087032, Marilyn Murphy Kane Trail, to augment the $500,000 donation made by the Kane Family. FINANCIAL STATEMENT This project will extend the multi-purpose trail constructed several years ago as part of the Bernal Creek Restoration Project, northerly up to the vicinity of Bernal Avenue. Once completed, the Parks Maintenance Division will incur additional costs in maintaining the project. The Kane Family of Pleasanton donated $500,000 in March, 2008 for construction of this trail. They have verbally pledged to contribute additional funds at some point in the future. Since the City had previously set aside $200,000 for construction of temporary trails on the Bernal Property that are not being constructed (CIP No. 047021), staff recommends utilizing $152,000 of these funds to augment the existing donation so that the trail can be constructed immediately.
