The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />Based on the proposal, the proposed facility would be a compatible use to the <br />nearby commercial establishments. The building where the proposed facility is to <br />be located is a freestanding building with its parking lot. As conditioned, the <br />number of parking spaces available on site would meet the parking demands <br />generated from the activities offered by the proposed use. Based on the proposal, <br />the City Traffic Engineer has determined that the proposed use would not result in <br />significant increases in vehicle trip volume when compared to the existing use at <br />the subject site. To ensure that the proposed use would to impose adverse impacts <br />onto the surrounding uses, a condition has been included addressing this issue. <br />Furthermore, a condition has been added requiring the facility management <br />exercise its discretion in assigning walk-in appointment and other functions/ <br />events, such as birthday parties, to avoid parking issue. Therefore, this finding <br />can be made with the proposed conditions of approval. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />As conditioned, the proposed use will comply with all provisions and <br />requirements of the City's zoning ordinance and the approved PUD development <br />plan if the proposed minor modification is approved by the City Council. As with <br />any conditional use permit, the use permit may be suspended or revoked if the <br />conditions are not met. Therefore, the proposed use will comply with the <br />provisions of the Zoning Ordinance. Therefore, this finding can be made with the <br />proposed conditions of approval. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-161, the application of Sherman Balch/SuperFranks for a <br />conditional use permit to operate an indoor recreational facility in an existing <br />building located at 5341 Owens Court, subject to the conditions shown in <br />Exhibit B, attached hereto and made part of this case by reference. <br />
