PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-200ti-13 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR SHERMAN <br />BALCH/SUPERFRANKS, AS FILED UNDER CASE PCUP-161 <br />WHEREAS, Sherman Balch/SuperFranks has applied for a conditional use permit to operate an <br />indoor recreational facility in an existing building located at 5341 Owens Court; <br />and <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development/Commercial) <br />District; and <br />WHEREAS, at its duly noticed public hearing of March 29, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the distriet in which <br />the site is located. <br />The objectives stated in the zoning ordinance include fostering harmonious, <br />convenient, workable relationship among land uses; protecting land uses from <br />inharmonious influences and harmfiil intrusions; and insuring that public and <br />private lands are used for the purposes which are most appropriate and beneficial <br />to the City as a whole. The proposed facility is an entertainment facility that <br />focuses on children and oriented to the entire family. All activities associated <br />with the use would be confined inside the building. In the past, the City has <br />approved similar uses which have been operating in the commercial-office zoning <br />districts without any land use conflict with other businesses in the surrounding <br />area. The proposed use would be consistent with the above-cited objectives. <br />Therefore, this finding can be made. <br />
