Maintenance shall include, but not <br />be limited to, the payment of all charges for electrical usage, <br />all cost of ownership charges, if any, and the care of all <br />street lighting electroliers and bulbs, including repair and <br />replacement where necessary: provided that Bernal's obligations <br />under this section shall not include the replacement or repair <br />of street lighting electroliers unless ownership of said <br /> electroliers is conveyed to Bernal, the property owners' <br /> association, if any, or the City. <br /> <br /> Section 3. MAINTENANCE OF BUS SHELTERS <br /> <br /> Bernal shall at its sole expense clean, maintain, <br />repair, and replace, where necessary, any and all bus shelters <br />existing or to be erected within Bernal Park, including <br />rights-of-way and easement areas along Valley Avenue Avenue <br />contiguous to Bernal Park. Bernal shall also remove trash from <br />any trash receptacles located at such bus shelters. Cleaning <br />and repair shall be done as frequently as reasonably necessary <br />to maintain the bus shelters in a safe and sightly condition. <br />Trash removal shalI be done at least weekly. <br /> <br />Section 4. MAINTENANCE OF INTERIOR STREETS <br /> <br /> 4.1 Interior Street Surface Maintenance. All surfaces of <br />interior streets to be constructed shall be maintained by <br />Bernal, by a property owners' association pursuant to <br />Section 9, or by some other privately funded comprehensive <br />procedure approved in writing by the City Engineer. <br />Notwithstanding the foregoing, City shall perform street <br />sweeping of interior streets in Bernal Park, at City's own <br />expense, in accordance with its usual street sweeping <br />procedures. <br /> <br /> 4.2 "Interior Street" Definition. For purposes of this <br />section, all streets to be constructed within Bernal Park not <br />including Valley Avenue nor Bernal Avenue shall be "interior <br />streets." Those portions of entrance streets constructed by <br />Assessment District No. 1982-5 shall be deemed portions of <br />Valley Avenue and Bernal Avenue for purposes of this section. <br />"Interior streets" shall include, but not be limited to, curbs <br />and gutters, asphalt surfaces, base material, median curbs and <br />gutters, striping and other painted surfaces. <br /> <br /> 4.3 Maintenance Standard. Interior streets shall be <br />maintained in accordance with good engineering practice to <br />ensure safe and hazard-free conditions and to ensure the proper <br />life of the improvements through preventive maintenance. <br />Maintenance shall be done as required by and to the <br />satisfaction of the City Engineer. Said maintenance shall <br />include, but not be limited to, repairing potholes and failed <br />sections of pavement/curbs and gutters, slurry sealing, <br /> <br /> -5- <br /> <br /> <br />
