K008-974 <br />07.31.85 <br />realestl-724 <br /> <br /> (i) all median landscaping between Valley Avenue <br /> and Interstate Freeway 680, provided the City shall obtain <br /> for itself or for Bernal or such property owners' <br /> association as its agent a written right of entry on such <br /> real property for such purpose, from the County of Alameda, <br /> which owns it: and <br /> <br /> (ii) all landscaping on the north side of Bernal <br /> Avenue located within the City right-of-way and the City <br /> public service easement between Valley Avenue and the <br /> Interstate Freeway 680 right-of-way, being generally a <br /> strip of land fifty (50) feet wide measured perpendicular <br /> from the face of curb on Bernal Avenue. <br /> <br /> 1.2.3 Interior Streets. All public landscaping <br />located within the rights-of-way of all interior streets, <br />either constructed or to be constructed, shall be maintained by <br />Bernal or, pursuant to Section 9, by a property owners' <br />association. Said landscaping shall include all median <br />landscaping (including median landscaping installed at entrance <br />streets by Assessment District No. 1982-5). Landscaping <br />located within interior street setback areas, whether within a <br />public service easement or not, shall be maintained by Bernal, <br />a property owners' association, or individual lot owners, as <br />determined by Bernal. Bernal shall give notice to the City of <br />who shall have maintenance responsibility for this area. <br /> <br /> 1.2.4 Developed Lots. As individual lots, or <br />portions of the Bernal Park, are developed and landscaped in <br />accordance with final plans approved by the City, all <br />landscaping included in the development on the lot, or portion <br />of Bernal Park developed, shall be maintained during the term <br />of this agreement by the owner of the lot or portion of Bernal <br />Park which is developed. <br /> <br /> 1.2.5 Arroyo del Valle Buffer Area. All landscaping <br />located within the Arroyo del Valle buffer area as established <br />by PUD-80-2, whether installed by Assessment District No. <br />1982-5 or subsequently installed, shall be maintained by <br />Bernal, or pursuant to Section 9, by a property owners' <br />association. <br /> <br /> 1.3 Maintenance Requirements. Bernal agrees to diligently <br />maintain and care for the landscaping, at its sole cost and <br />expense, using generally accepted methods for maintenance. All <br />planrings shall be maintained in a healthy, attractive, and <br />weed-free condition, using generally accepted methods of <br />cultivation and standard of care necessary to ensure normal, <br />healthy plant growth.
