Vice-Chairperson Roberts stated she could not make any of the findings. She expressed concern with <br />the proximity of business to the Arroyo, non-compliance with City requirements, no sewer access, and <br />effects on the public's health, safety and welfare. She stated that this piece of land is not ready for the <br />applicant's varied uses; the business would have to be much smaller. She is also bothered by the <br />applicant's non-compliance, therefore, she would vote in favor to deny the application. <br />A motion was made by Commissioner Cooper, seconded by Commissioner Kemeny, to deny Case <br />UP-98-37/Z-98-176. <br />ROLL CALL VOTE <br />AYES: Commissioners Cooper, Kemeny, Sullivan and Vice-Chairperson Roberts, <br />NOES: None <br />ABSENT: Chairperson Kumazan <br />ABSTAIN: Commissioner Maas <br />Resolution No. PC-98-89 was entered and adopted as motioned. <br />Mr. Iserson noted that the applicant has 15 days to appeal to the City Council the decision of the <br />Planning Commission. <br />b. Braddock & Logan <br />-- Application for: (1) PUD rezoning of a one-acre parcel located at 1635 Rose Avenue from <br />the A (Agriculture) zoning district to the PUD (Planned Unit Development) -MDR <br />(Medium Density Residential) zoning district; and (2) PUD development plan approval for <br />34 lots, ranging in size from 7,600 square feet to 13,400 square feet, on 13.3 acres located at <br />1635, 1777 and 1851 Rose Avenue, generally at the westerly terminus of Rose Avenue. <br />Zoning for the property is A (Agriculture) and PUD (Planned Unit Development) -MDR <br />(Medium Density Residential) District. The Planning Commission will also consider the <br />Negative Declaration prepared for the project. <br />Continued to December 9, 1998. <br />c. PUD-81-30-77D. PUD-85-8-12D, Homestead Villaee Inc. <br />Application for Planned Unit Development design review approval for an approximately <br />61,300-square foot, three story, 131-unit extended stay hotel with a manager's apartment <br />located at 4750 Willow Road. Zoning for the property is PUD (Planned Unit Development) <br />- I/C/O (IndustrzaUCommercial-Office) District. <br />Mr. Iserson referenced a staff report dated November 23, 1998, and highlighted key areas contained in <br />the report including background information, site description, project description, land use, market <br />study, azchitectural design, traffic circulation, and parking.
