Commissioner Sullivan requested that the EIR address Interstate 580 noise issues. <br />(Recess taken from 8:20 to 8:30 p.m.) <br />a. UP-98-37/A-98-176 Peter ShuttsBuss Moran <br />Application for design review and conditional use permit approvals to allow a rental yard, <br />outdoor storage, and accessory uses, to allow the placement of five modular buildings and <br />14 shipping containers on site, and to allow the construction of a patio cover, a new <br />business sign, and the repainting of an existing building located at 3878 Stanley Blvd. <br />Zoning for the property is C-5 (Service Commercial) District. <br />Commissioner Maas stated she will be abstaining from discussion and voting due to a conflict of <br />interest. She left the dais. <br />Mr. Iserson referenced a staff report dated November 23, 1998, and highlighted key areas contained in <br />the report including background information, previous and on-going municipal code violations, the <br />applicant's proposal, site description, hours of operation, vehicles on site, drive aisle requirements, fire <br />codes, outdoor storage, landscaping and screening, noise, signage, land use, sanitary sewer, and Del <br />Valle Pazkway extension. In conclusion, Mr. Iserson stated that staffs recommendation is that the <br />Planning Commission deny Case Up-98-37/Z-98-176; however, if the Planning commission believes <br />that the required findings can be made, staff recommends the Planning Commission make specific <br />required use permit findings for approval and adopt a resolution which would approve Case <br />UP-98-37/Z-98-176 subject to the Conditions in Exhibit "B". <br />Discussion ensued between Commissioners and staff relating to whether the applicant will be required to <br />close down the business if the permit is denied, the possibility of approving a temporary permit, and the <br />status of the applicant's current permit. <br />PUBLIC HEARING WAS OPENED <br />Peter Shutts, architect, 4133 Mohr Avenue, addressed the Commission and disclosed he had previous <br />discussions with Commissioners Cooper and Roberts relating to the building plan. He stated that <br />approval of this permit would allow continuation of Mr. Morgan's business until a new building plan is <br />presented and approved. Mr. Shutts provided an extensive overview of the plan and addressed issues <br />relating to the size of the trailers and vehicles for rent, placement of handicapped pazking spaces, <br />landscaping, noise on Stanley Boulevazd being higher than business noise, drainage and sewage issues. <br />He requested that the Commission consider approving dishwashing and laundering facilities subject to <br />an agreement being reached between the County Health Deparhnent and the City of Pleasanton <br />regarding appropriate disposal of waste water. <br />He addressed Exhibit "B," Draft Conditions of Approval and stated he is in agreement will all conditions <br />of approval with the exception of No. 9 due to his desire to work with the County on an interim solution <br />or elimination of the dishwashing/washing facility; No. 12, due to his request that the condition be <br />_ changed to two months from the date of issuance of building permits versus approval of the case; No. <br />PLANNING COMMISSION MINUTES Page 5 November 23, 1998 <br />
