Mr. Summers responded that trees will be planted at the rear of custom lots and that setbacks are 50 feet <br />on parameter lots for both custom and production homes. <br />Mark Locher, 3615 Ashwood Drive, commended the developer for his cooperation in working with the <br />neighbors. He stated that the influx of students at schools will be gradual, the density of project is <br />within the General Plan guidelines, and a stop sign should be erected on Foothill until a traffic light is <br />installed. <br />Jim Amos, 7827 Foothill Knolls Drive, expressed concern with the manufacturing plant continuing and <br />the dumping of solvents into the soil. He informed the Commission of having had discussion with an <br />attorney relating to the dumping of solvents and requested that the Commission provide copies of all <br />hazazdous reports done on the Merritt property. He expressed his support of a seven-foot fence around <br />the pazameter of project and with 36-inch box trees. He spoke in opposition to the density of project due <br />to impact on the schools and called the Commission's attention to the fact there is still no bussing of <br />students to schools. <br />Mr. Iserson noted that the levels of contaminants contained in the soil at the Merritt property were found <br />to be non-harmful to future inhabitants. <br />Jerry Sparrow, 3771 Muirwood Drive, commended the developer for their cooperation in working with <br />neighbors on the project. He expressed concern with cut-through traffic on Muirwood. <br />Janyce Locher, 3615 Ashwood Drive, requested that the developers address issues relating to the <br />rebuilding of the Bernal Bridge to allow pedestrian access. Further, she suggested the Commission <br />consider widening West Las Positas to four lanes to dissuade traffic cutting through neighborhood. <br />Discussion ensued between the Commissioners and the Fire Marshal relating to the contaminated soil <br />cleanup at the Merritt property. Also discussed was the construction starting on the Bernal Bridge in <br />early spring 1999, and the status of the West Las Positas interchange. <br />(Recess taken from 9:45 to 9:55 p.m.) <br />Mr. Summers readdressed the Commission and stated that growth management measures are in place <br />and that negotiations are taking place to begin construction on the new elementary school. He requested <br />that the Commission leave lot 37 as a Master-Down lot due to adequate setbacks of property. He stated <br />that the he agrees to the conditions on trees for lots 5-16, 17-27 and 37, that neighborhood input relating <br />to the tot lot is desired, single-story homes will be constructed on lots 3 and 4, the pazameter custom <br />homes will have 50-foot setbacks, and the Bernal Bridge will have pedestrian access. He also agreed to <br />single-story homes on lots 38 and 39. <br />Mr. Summers continued by stating that Mr. Merritt has worked closely with the various agencies to <br />ensure compliance with codes and that the applicant has committed to removing the point source of <br />contamination and the high pH soil. <br />PLANNING COMMISSION MINUTES Page 6 September 23, 1998 <br />
