_ Al Spotorno, Spotorno Ranch, commented that he has a complete report by his attorney in <br />response to the EIR and the Happy Valley Specific Plan. He will leave it with the Commission <br />for review. He noted that he has some very grave concerns about the economic viability of this <br />project. He also stated that the cost allocation of the Bypass Road should be equitable and fair, <br />and he cannot bear the cost of the entire road for the whole community. He stated that the <br />agricultural element in the Plan needs to be reviewed more closely in order to preserve the <br />agriculture in the area. He further stated that extensive studies of the Verona Fault have been <br />done by the golf course developers, Greenbriar, New Cities, and by himself, and nobody has <br />found any evidence of a fault in that area. With regard to the tiger salamander, he feels its not an <br />endangered species and, therefore, feels that no study needs to be done regarding that issue. <br />John Spotorno, Spotorno Ranch, commented that after reading the EIR, he feels it should <br />consider the impact as the area exists, rather than after the anticipated development. He likewise <br />stated that the Specific Plan alternative has the least amount of impact, but it also fails to take <br />into consideration the project when finished. A brief discussion followed between Mr. Spotorno <br />and Mr. Rasmussen relating to how EIR's are prepared. Mr. Spotorno stated that the biggest <br />issue is the Bypass Road and he understood that the cost of the road would be funded by a <br />pro-rata share of who will be using it in that area. However, the way he interprets the Specific <br />Plan, is that the Spotorno Development would have to pay for the road from the edge of the <br />NSSP up to the Spotorno Medium Density Residential area. Mr. Higdon stated that under the <br />- NSSP, if the roadway is required to serve the developer's subdivision and is not required to be <br />oversized, then it is fully the developer's responsibility to pay the cost. However, if the road <br />goes beyond the main development, then it is subject to cost sharing. Amore detailed discussion <br />took place between Mr. Spotorno and Mr. Rasmussen relating to cost-sharing of the Bypass <br />Road. <br />Janet Linfoot, 6300 Alisal Street, stated that she disagrees with Mr. Spotorno that the tiger <br />salamander is not endangered. Mr. Rasmussen noted that although the species is not <br />endangered, it is considered a species of special status. He noted that all of the golf course <br />property and the residential area around it is tiger salamander habitat according to the <br />Department of Fish and Wildlife and, to a lesser extent, the Spotorno property. <br />PUBLIC HEARING WAS CLOSED <br />Chair Cooper stated that he would like to see the Specific Plan benefit all of the area land owners <br />in an equitable way. He also expressed concern with the cost sharing Spotornos' issues, and <br />wants them to be fairly treated. <br />Mr. Rasmussen recommended that the first formal meeting on the Happy Valley Specific Plan <br />be held at the second meeting in April. He also noted that since there are five Wednesdays in <br />April, a special meeting could be held on the fifth Wednesday.
