Commissioner Wright agrees with Chair Cooper on the placement of the trail He recommends <br />amending Conditions 2 and 3 to allow recording of the lots now, but does not want any building <br />permits issued until the infrastructure is in place. He supports staff s recommendation on <br />Condition 4. With regard to Condition 10, he recommends just putting the word "developer" in <br />rather than "New Cities" because it is not really known at this time who the developer will be. <br />Commissioner Barker supports staffs recommendations. She also feels that if the original NSSP <br />showed the trail going through the Frost property, then the plan should remain in place. But, if <br />the trail is going to go through the Locke and Richey access road, then she is concerned about <br />the impact this would have on the Locke's privacy and legal exposure. Following a brief <br />discussion, Commissioner Barker stated that the City should absolve the Locke's of all liabilities. <br />A motion was made by Commissioner Wright, seconded by Commissioner Kumaran, <br />recommending that the PUD development plan is consistent with the General Plan, <br />purposes of the PUD ordinance, and North Sycamore Specific Plan. <br />ROLL CALL VOTE <br />AYES: Commissioners Barker, Dove, Kumaran, Wright, and Chair Cooper <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />A motion was made by Commissioner Wright, seconded by Commissioner Dove, <br />recommending approval of PUD-97-21 subject to the Conditions shown in Exhibit "B", <br />except with the following amendments: <br />2. A final map creating Parce-s "1", " 2", and " 3" of this PUD development plan may <br />be recorded by the applicant. However, no building permits shall be issued until such time <br />that City sewer and water service is available for use by the new homes in this <br />development. It shall be the determination of the Planning Director and City Engineer as <br />to when these services are deemed available. <br />Conditions 5, 8, and 39 shall be amended as detailed by staff in the March 11, 1998 <br />Memorandum.
