10 <br />.TH,E CITY OF <br />~~ °- "' CITY COUNCIL AGENDA REPORT <br />j~L~ t1S~4NTON- <br />October 7, 2008 <br />Community Development <br />Engineering Division <br />TITLE: ACCEPTANCE OF PUBLIC IMPROVEMENTS PERFORMED BY <br />MCNAMARA AND SMALLMAN CONSTRUCTION INC. FOR ANNUAL <br />SANITARY SEWER REPLACEMENT, CIP NO. 072002 <br />SUMMARY <br />The subject project consisted of replacement of existing damaged sewer mains, laterals <br />and manholes along Old Bernal Avenue, Bernal Court, Amaral Circle, and portions of <br />Mirador Avenue. The subject project is complete and ready for acceptance by City <br />Council. <br />RECOMMENDATION <br />1. Accept the improvements for the subject project. <br />2. Authorize the City Clerk to file a Notice of Completion. <br />3. Authorize payment of the retention in the amount of $44,255.50 to McNamara <br />and Smallman Construction Inc. thirty days after recordation of the Notice of <br />Completion. <br />4. Authorize final payment to McNamara and Smallman Construction Inc. in the <br />amount of $2,700. <br />5. Authorize the transfer of $54,794 back into the Sewer Replacement Fund. <br />FINANCIAL STATEMENT <br />This project will replace and upgrade existing infrastructure and should not increase <br />maintenance costs. The construction of the project was performed within the approved <br />budget and no contingency funds were used. <br />
