BACKGROUND <br />If, at any election, two or more persons receive an equal and the highest number of <br />votes for an office to be voted upon in the city, the tie shall be resolved in one of the <br />following ways: By lot (e.g., coin toss, drawing of straws, drawing of names, etc.) or by <br />special election. A special runoff election shall be held only if the City Council adopts the <br />provisions of § 15651 (b) of the Election Code prior to the election resulting in the tie vote. <br />All future elections conducted by the City will be resolved likewise, unless the Council <br />later repeals the resolution establishing a special runoff election for tie votes. <br />If a special runoff election is held, the City Council shall call for the runoff election to be <br />held on a Tuesday, not less than 40 nor more than 125 days after adoption of the <br />resolution declaring the results of the election resulting in the tie vote.
