THE CITY OF <br />-~- "' CITY COUNCIL AGENDA REPORT <br />PLC ~S~4NTON- <br />October 7, 2008 <br />Administrative Services <br />TITLE: ADOPT A RESOLUTION PROVIDING FOR OF A SPECIAL RUNOFF <br />ELECTION FOR ELECTIVE OFFICES IN THE EVENT OF A TIE VOTE AT <br />ANY MUNICIPAL ELECTION <br />SUMMARY <br />Section 15651 of the Elections Code sets procedures to solve a tie vote for two or more <br />persons receiving an equal and the highest number of votes for an elective office. The <br />two ways of resolving a tie are by lot or by a special runoff election. Absent adoption of <br />a resolution providing for a special runoff election prior to the election resulting in the tie, <br />the tie would be resolved by lot, e.g., tossing a coin, drawing of straws, drawing of <br />names, etc. <br />RECOMMENDATION <br />Adopt the attached resolution providing for a special runoff election for elective offices in <br />the event of a tie vote at this and any future municipal election. <br />FINANCIAL STATEMENT <br />There is no current fiscal impact associated with this item. If a special runoff election <br />needed to be conducted, the cost would be about $95,000. <br />
