(d) CITY shall perform the testing/surveillance work and <br /> <br />complete the report described in Paragraph 3(a) following approval by COUNTY of <br /> <br />a scope of work for said study. <br /> <br /> 5. Compensation and Method of Payment. <br /> <br /> (a) Maintenance Costs For Budgeted Expenses <br /> <br /> (1) CITY shall provide the COUNTY m~nthly with an invoice <br /> <br />of CITY's actual costs and expenses, including administration for each month of <br />services included in the synopsis of work approved pursuant to Section 4(a). <br />Interest at a rate of ten percent (10%) per year shall accrue on each unpaid <br />monthly invoice from the first day of the succeeding month until paid. By <br />August 1st each year, CITY shall provide COUNTY with an invoice summarizing the <br />CITY's actual costs and expenses for services during the prior Fiscal Year <br />including interest. This amount shall be due and payable within 30 days of <br />receipt of City's invoice. <br /> <br /> (2) COUNTY shall not be liable for budgeted and unbudgetd <br /> <br />costs and expenses which are in excess of one hundred twenty percent (120%) of the <br />approved budget estimate unless the County has agreed to such increased cost and <br />authorized same. <br /> <br /> (b) Utility Costs. COUNTY shall directly pay for all utility <br /> <br />costs incurred in the maintenance and operation of the New and Old Facilities. <br /> <br /> (c) Capital Costs and Labor Costs for Unbudgeted Expenses. Costs <br /> <br />and expenses for unbudgeted maintenance/repair, including emergency maintenance/ <br />repair, shall be reimbursed. CITY shall include capital and labor costs for <br />unbudgeted and emergency repair in its monthly invoice and in the yearly summary <br />invoice and shall be directly reimbursed for such costs, including interest <br />calculated as in Section 5(a), at the time the yearly payment is made. <br /> <br /> (d) None of the costs and expenses incurred for unbudgeted and <br /> <br />emergency maintenance/repair shall be counted as part of the 120% of budget <br /> <br />estimate limitation included in Section 5(a) (2) above. <br /> <br /> <br />
