(d) CITY shall perform the testing/surveillance work and complete the report described in Paragraph 3(a) following approval by COUNTY of a scope of work for said study. 5. Compensation and Method of Payment. (a) Maintenance Costs For Budgeted Expenses (1) CITY shall provide the COUNTY m~nthly with an invoice of CITY's actual costs and expenses, including administration for each month of services included in the synopsis of work approved pursuant to Section 4(a). Interest at a rate of ten percent (10%) per year shall accrue on each unpaid monthly invoice from the first day of the succeeding month until paid. By August 1st each year, CITY shall provide COUNTY with an invoice summarizing the CITY's actual costs and expenses for services during the prior Fiscal Year including interest. This amount shall be due and payable within 30 days of receipt of City's invoice. (2) COUNTY shall not be liable for budgeted and unbudgetd costs and expenses which are in excess of one hundred twenty percent (120%) of the approved budget estimate unless the County has agreed to such increased cost and authorized same. (b) Utility Costs. COUNTY shall directly pay for all utility costs incurred in the maintenance and operation of the New and Old Facilities. (c) Capital Costs and Labor Costs for Unbudgeted Expenses. Costs and expenses for unbudgeted maintenance/repair, including emergency maintenance/ repair, shall be reimbursed. CITY shall include capital and labor costs for unbudgeted and emergency repair in its monthly invoice and in the yearly summary invoice and shall be directly reimbursed for such costs, including interest calculated as in Section 5(a), at the time the yearly payment is made. (d) None of the costs and expenses incurred for unbudgeted and emergency maintenance/repair shall be counted as part of the 120% of budget estimate limitation included in Section 5(a) (2) above.
