(b) Following receipt of CITY's report, ~il'Y shall meet with <br /> <br />representatives of Castlewood Property Owners Association and the Castlewood <br />County Club and shall develop and implement a program to replace and/or repair <br />portions of the Old Facilities, with priority emphasis on replacing/repairing high <br />frequency maintenance areas and areas of highest infiltration/inflow. <br /> <br /> (c) CITY, as part of its maintenance function, shall include <br /> <br />such testing/surveillance as it deems reasonable and prudent, and shall notify <br />COUNTY of any improvements/repairs with a capital cost of greater than $2,500 <br />which should be undertaken within the upcoming.fiscal year. <br /> <br /> 4. Authorization to Perform Work. <br /> <br /> (a) CITY will provide COUNTY, by March I annually, a synopsis of <br /> <br />work to be done by CITY during the following fiscal year for (i) maintenance <br />of the New Facilities and the Old Facilities and (ii) routine testing/surveillance, <br />CITY shall provide a budget estimate of the cost of providing such services. <br />Following COUNTY's review, COUNTY and CITY shall mutually approve, in writing, <br />the synopsis of work and a budget, prior to CITY's undertaking such work. <br /> <br /> (b) Repairs not included in the approved budget which involve <br /> <br />capital costs of less than or equal to $2,500 may be undertaken by CITY as it <br />deems necessary and advisable. The aggregate cost of repairs less than or equal <br />to $2,500 shall not exceed 10% ~ the approved budget, without prior approval of <br />County. <br /> <br /> Repairs not included in the approved budget which capital <br /> <br />costs of greater than $2,500 shall be undertaken by City only after receiving <br /> <br />COUNTY approval. <br /> <br /> (c) Emergency repairs, as reasonably deemed necessary by the CITY <br /> <br />in order to keep the Old Facilities and New Facilities operational, may be made <br />immediately without prior COUNTY approval. CITY shall notify County of emergency <br />repairs immediately after repairs have begun and in no case later than the next <br />business day. The cost of any single emergency repair shall not exceed 10% of <br />the budget, unless approved by the County <br /> <br /> -3- <br /> <br /> <br />
