(d) The parties agree that the effect of <br />Paragraph l is to suspend the running of the remaining <br />portion of the three year period referred to in paragraph <br />3(b) with respect to each Sewer Permit by the period during <br />which Owner is prevented by this Agreement from obtaining <br />building permits for construction of buildings to which such <br />Sewer Permits relate. Such period for each Sewer Permit <br />shall be from the date hereof through the expiration of the <br />sixty (60) day period described in paragraph l(b) following <br />the date of final approval of design and approval of the <br />traffic study analysis with respect to the portion of the <br />Property to which such Sewer Permit relates. Owner shall <br />designate the number of Sewer Permits to be associated with <br />the Project approved pursuant to paragraph 1 within the <br />sixty (60) day period described in paragraph l(b). <br /> <br /> 3. Additional Sewer Restrictions. Crow agrees <br /> <br />to the restrictions imposed by this Paragraph for so long as <br />there remain valid Sewer Permits which have not been <br />allocated to improvements which are the subject of building <br />permits (whether or not such buildings have been <br />constructed). Owner or any successor in interest to a <br />portion of the Property which has been subdivided or <br />otherwise legally divided from the balance of the Property, <br />shall not be entitled to obtain additional sewer capacity <br />from the City pursuant to its "first come, first served" <br /> <br /> -7- <br /> <br /> <br />
