(ii) Should a court find other thai~ <br /> as set forth in this subsection, Owner agrees to <br /> pay the amount deemed appropriate by the court. <br /> <br /> (3) The Sewer Permits are transferable <br />to a purchaser of all or a portion of the Property. <br /> <br /> (4) Each Sewer Permit is an entitlement <br />to 280 gallons per day of sewer capacity <br />notwithstanding any change in computation of Dwelling <br />Unit Equivalents. <br /> <br /> (5) The three year period for the <br />Property Sewer Permits was tolled for a period of 547 <br />days from June 9, 1981 to December 9, 1982. <br /> <br /> (6) After adjusting for the effect of <br />the tolling described in subparagraph .(c)(5) above, as <br />of May 21, 1985, the amount of the three year period <br />remaining to obtain building permits with respect to <br />the Sewer Permits is one hundred thirty six (136) <br />days. <br /> <br /> (7) The Owner may allocate the Sewer <br />Permits to improvements or subdivided portions of the <br />Property without the approval of City, by Grant Deed or <br />other instruments acceptable to Owner, provided, <br />however that Owner shall provide City with a notice of <br />assignment in each case upon such allocation. <br /> <br /> <br />
