56. The applicant shall reimburse the Safeway Corporation their pro-rata share of the sidewalk installed across the Stoneridge Mall Road project frontage. Said pro- rata share shall be paid prior to the issuance of a building permit. Construction Requirements 57. All construction activities shall be limited to the hours of 6:00 a.m. to 7:00 p.m., Monday through Saturday. In addition, no construction shall be allowed on Federal or State Holidays and the applicant shall create a modified construction schedule to mitigate any disruptions or conflicts caused by construction activities during the busy Holiday shopping periods (i.e., the day after Thanksgiving and the two weeks before and after December 25th). The modified construction schedule shall be subject to review and approval by the Director of Planning and Community Development. The applicant shall post and maintain a sign at the entrance to the site with the approved days and hours of construction as notification to all job site workers. All construction equipment must meet Department of Motor Vehicles (DMV) noise standards and shall be equipped with muffling devices. 58. A construction trailer shall be allowed to be placed on the project site for daily administration/coordination purposes during the construction period. At no time shall campers, trailers, motor homes, or any other vehicle be used as living or sleeping quarters on the construction site. All such vehicles shall be removed from the site at the end of each workday. 59. Dust and mud shall be contained within the boundaries of the property during times of construction. The project developer shall submit a dust control plan or procedure as part of the improvement plans. 60. The project developer shall submit a waste generation disposal and diversion plan to the Planning Division prior to construction. The plan shall include the estimated composition and quantities of waste to be generated and how the project developer shall recycle at least fifty percent (50%) of the job site construction and demolition waste. Proof of compliance shall be provided to the Director of Planning and Community Development prior to final inspection. During demolition and construction, the project developer shall mark all trash disposal bins "trash materials only" and all recycling bins "recycling materials only." The project developer shall contact Pleasanton Garbage Service for all waste disposal. Only that portion of trash and recycling waste refused by Pleasanton Garbage Service shall be disposed of or diverted by another trash/recycling company. 61. If grading or tree removal is to occur during the raptor-nesting season (February 1 to August 31), a focused survey for raptor nests shall be conducted by a qualified biologist during the nesting season. The survey shall be conducted no less than 14 days and no more than 30 days prior to the beginning of grading 9
