ATTACHMENT 2 <br />Attachment A <br />MEMORANDUM OF UNDERSTANDING <br />FOR <br />PARATRANSIT SERVICES <br />This Memorandum of Understanding for Pazatransit Services (MOU) is entered into this <br />day of , 2008 between the Livermore Amador Valley Transit Authority, a joint <br />powers authority (LAVTA) and the City of Pleasanton, a municipal corporation (City). <br />RECITALS <br />a) LAVTA provides local public transit service (Wheels) to the cities of Dublin, Livermore, <br />Pleasanton and the immediately adjacent unincorporated areas of Alameda County within its <br />jurisdiction, by offering fixed-route local and intercity service, inter-regional express buses, as <br />well as pazatransit service (known as Wheels Dial-a-Ride) as mandated by the Americans with <br />Disabilities Act (ADA), transportation for students going to and from school, and shuttles. <br />b) The City offers scheduled door-to-door transportation services on Pleasanton Pazatransit <br />Service (PPS) vehicles in Pleasanton, unincorporated portions of Alameda County within the <br />City's sphere of influence and the community of Sunol for persons who are age 60 and older, and <br />persons between the ages of 18-59 years old who qualify for paratransit service pursuant to the <br />ADA. <br />c) LAVTA and the City desire to enter into this MOU to coordinate paratransit services for <br />persons age 60 and older, as well as qualified disabled persons, to better serve that community <br />and to comply with the ADA. <br />NOW, THEREFORE, in consideration of the promises herein, the parties agree as <br />follows: <br />1. ADA Certification. <br />a) An ADA certified, or eligible, person is a person who because of that person's <br />disability or health-related condition: (i) cannot independently boazd, ride and/or <br />disembazk from an accessible fixed-route transit bus; or (ii) cannot get to or from a <br />boazding or disembazking location. Applicant can be granted unconditional (all <br />trips), conditional (some trips) or temporary (conditional/unconditional) eligibility. <br />b) Very young children are normally not eligible for ADA mandated Wheels Dial-A- <br />Ride because young children aze prevented from using fixed route transit <br />independently by their age, not by their disability. Very young children may be <br />eligible on a case-by-case basis. <br />c) All ADA eligible persons must register with Wheels or be ADA certified by another <br />Bay Area transit agency before scheduling a ride with Wheels Dial-A-Ride or PPS. <br />Page 1 of 5 <br />
