Article II.B of the Long-Term Agreement, building permits may be <br />granted pursuant to the Long-Term Agreement, and for utilization <br />within the time limit set forth in the Long-Term Agreement. In the <br />event of the expiration of either the growth management approval or <br />the building permits issued pursuant thereto, the growth management <br />approval so expiring may be reallocated by the City in accordance <br />with its Growth Management Program. <br /> <br /> 2. Ponderosa will acquire and become the fee owner of that <br />certain property consisting of approximately 2.9 acres referred to <br />as Parcels B and C of Parcel Map No. 4459 more fully described on <br />Exhibit "A" attached hereto and made a part hereof (the "Property"). <br />In connection with such acquisition, Ponderosa will allocate 19 <br />sewer permits issued to Ponderosa by the Dublin-San Ramon Sewer <br />District pursuant to the 1972 Settlement Agreement for utilization <br />in the'development of the Property in accordance with the schedule <br />described hereinbelow and attached hereto as Exbibit "B". <br /> <br /> 3. All the terms and conditions of the Long-Term Agreement <br />shall remain in full force and effect as to the Project except as <br />explicitly provided herein. <br /> <br /> 4. Pursuant to the Fourth Addendum growth managment approval <br /> <br />for 49 units was allocated to Parcels A, B and C of Parcel Map 4122 <br />for 1984 and 97 units was allocated to Parcels A, B and C of Parcel <br />Map 4122-for 1985. The sum of the foregoing allocation being 146 <br />units. However, said Parcels A, B and C as subdivided by Tract Maps <br />5093, 5163, 5224 and 5256, and Parcels A, B, C and D of Parcel Map <br />4338 comprise only 145 lots. Hence, 1 unit was allocated in error <br /> <br /> -2- <br /> <br /> <br />
