8. This project shall be annexed to Silver Oaks Estates Phase I, and there shall be <br />a single homeowners association to own and maintain the common areas and <br />facilities covered by PUD-05, Tract 7399, and the tract for this project. <br />9. A final landscape plan enhancing the landscape plan included in the PUD-05 <br />approval shall be submitted to the Planning Division for review and approval, <br />requiring all frontage landscaping along Vineyard Trail, Lots 6-10, and shall be <br />installed with an automatic irrigation system prior to the first lot being sold. <br />10. The rear lot lines for Lots 1-5 shall be adjusted so that a minimum of five feet <br />exist between the rear lot line fence and the face of the retaining wall. This area <br />shall be a part of Parcel C and shall contain the drainage swale at the top of the <br />wall and the fire buffer, mowed area described in the Open Space Management <br />Plan and Wildland Protection Plan. <br />11. When retaining walls are offset as shown in Lots 6-9, appropriate retaining walls <br />shall be constructed on the property line to link the walls, as necessary; such <br />walls shall be shown on the final grading plan and shall be reviewed and <br />approved by the Director of Planning and Community Development prior to the <br />approval of the final map. <br />12. The retaining wall at Vineyard Avenue Trail shall be either a decorative wall or <br />shall be set back sufficiently to have shrub landscaping planted between it and <br />the horse path. Final design shall be subject to the review and approval by the <br />Director of Planning and Community Development prior to the approval of the <br />final map. <br />13. No retaining walls are required around existing utility poles as shown on the <br />tentative map preliminary grading and utility plan due to the removal of the <br />overhead utility lines along Vineyard Avenue Trail. Alternately, if the overhead <br />lines have not been removed, retaining walls shall remain required. The <br />applicants shall coordinate with the City Engineer. <br />14. Unless otherwise approved by the Fire Marshal, no house construction shall <br />begin until such time as an acceptable emergency vehicles access has been <br />established, as defined by the Fire Marshal. This access shall be maintained at <br />all times until the public improvements are accepted. <br />15. No sports court shall be allowed in this development. This shall be added to the <br />Design Guidelines and CC&R's. <br />16. Trucks hauling excavated materials shall be covered with tarpaulins or other <br />effective covers, subject to the approval of the Director of Planning and <br />Community Development. In addition to regulating the haul route to and from <br />this project, the City Engineer shall regulate the hours of all truck traffic so as to <br />avoid conflicts with school traffic during peak school drop-off and pick-up hours <br />and shall preclude use of the school loop road as a portion of the approved haul <br />route. <br />2 <br />
