IV. The amount to be paid by the OPERATOR upon execution <br /> of this Contract for the services to be performed by the <br /> CONTRACTOR is Five Hundred Dollars ($500.00) per year <br /> (payable semi-annually). On contracts covering a period <br /> of more than one year, all terms and conditions shall remain <br /> the same with the only exception being the yearly charge <br /> which will be a matter of negotiation. <br /> <br /> V. This Contract shall remain in force from the date of execution <br /> by CONTRACTOR and may be terminated by either party <br /> upon thirty (30) days written notice. <br /> <br />In the event the settlement of any controversy or claim arising out <br />of or relating to this agreement as to breach thereof cannot be concluded <br />by the parties to this Service Contract, they shall resort to arbitration <br />upon written request one to the other. Such arbitration shall be in <br />accordance with commercial arbitration rules then in effect of the <br />American Arbitration Association and both parties agree to abide by <br />any decision resulting from such arbitration. If necessary, the decision <br />of the American Arbitration Association may be enforced by the courts <br />having jurisdiction over this Contract. <br /> <br />In the event arbitration or legal action is brought by either party to <br />this Contract, the prevailing party shall be entitled to costs and <br />attorneys' fees which will be made a part of the award judgement. <br /> <br />The laws of the State of California apply and bind the parties in any <br />and all questions arising hereunder, regardless of the jurisdiction in <br />which any action or proceeding may be initiated or maintained. !t <br />is understood, however that this is a general form of agreement and <br />if any of its provisions are contrary to the laws of the State or <br />Territory, such provisions shall be deemed not to be a part of this <br />agreement, and the remainder of this agreement shall remain in full <br />force and effect. <br /> <br />CONTRACTOR: <br /> <br />BY <br /> <br />TITLE <br /> <br />DATE OF EXECUTION <br /> <br />OPERATOR: <br /> <br />TITLE <br /> <br />DATE (CONTRACTORS LICENSE <br /> #381218) <br /> <br /> (Page 3 of 3) <br /> <br /> <br />
