(C) The CONTRACTOR shall replace equipment found <br /> defective due to improper design or faulty manu- <br /> facture within the terms of the installation purchase <br /> agreement. If the defect is the result of conditions <br /> not disclosed to the CONTRACTOR at the time of <br /> system design, or improper handling by the OPERATOR, <br /> or a change in plant conditions, the charges incurred <br /> to bring the system up to the proper standard of <br /> protection shall be borne by the OPERATOR. The <br /> CONTRACTOR shall replace equipment subject to normal <br /> deterioration such as batteries, explosive devices, etc., <br /> and the expense of such replacement shall be borne <br /> by the OPERATOR. If plant conditions exist which <br /> accelerate such deterioration, such conditions shall <br /> be noted in the Inspection Report. <br /> <br /> (D) The CONTRACTOR, in the event of actuation of the <br /> protection system, shall provide service personnel to <br /> inspect the installation and recommend the reconditioning <br /> and/or replacement of equipment necessary to return <br /> the protection system to its original state. Costs for <br /> reconditioning and/or replacement to be borne by <br /> OPERATOR. The system shall not be placed in <br /> operation until final inspection by the CONTRACTOR'S <br /> service personnel has been performed. A report shall <br /> be forwarded as stated in Paragraph I (A) outlining <br /> the work performed. <br /> <br /> (E) The CONTRACTOR shall provide emergency service <br /> on a 24 hour basis for service calls related to circuitry <br /> trouble conditions and/or alarm conditions. <br /> <br /> Calls by the OPERATOR for service other than repair, <br /> maintenance, and alarm conditions, shall be billed at <br /> $50.00 per hour, portal to portal. <br /> <br /> I!. The OPERATOR shall advise the CONTRACTOR of any <br /> changes made in the equipment, operating procedures, <br /> installation, or plant, prior to the incorporation of such <br /> changes. This Contract shall not cover the charges for <br /> any work performed by the CONTRACTOR necessary to <br /> render the system satisfactory for the changed conditions. <br /> <br />III. The term of this Contract shall be for a period of one (1) <br /> year, beginning on the date of execution, unless sooner <br /> terminated by either party as provided herein. <br /> <br /> (Page 2 of 3) <br /> <br /> <br />
