AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into by and between the COUNTY <br /> <br /> OF ALAMEDA (hereinafter called "County", and the , <br /> a municipal corporation (hereinafter called "City"). <br /> <br /> WITNESSETH <br /> WHEREAS, the City has requested the County to col lect al 1 <br /> assessments and charges levied by it against real property within the City; and <br /> <br /> WHEREAS, the County charter authorizes any county officer to <br /> perform any City functions approved by the Board of Supervisors upon the terms <br /> and conditions and for the compensation agreed upon between the parties; <br /> <br />NOW, THEREFORE, in consideration of the mutual promises herein <br />contained, it is agreed; <br /> <br /> 1. The County agrees to collect, enforce and distribute all <br />assessments and charges levied by the City on real property which become a <br />lien on such real property within the City except as prohibited by law. <br /> <br /> 2. Annually, before August 15, the City shall provide the County <br />with an official list of all charges and assessments to be collected by the <br />County for that fiscal year. <br /> <br /> 3. The County shall use its best efforts to collect all charges <br />and assessments requested by the City but may, in its discretion, refuse to <br />collect an assessment or charge if time or space does not permit its <br />collection on the County tax bill. If the County does not collect all the <br />assessments or charges requested, it shall immediately notify the City of any <br />charges or assessments which will not be collected. <br /> <br /> 4. All charges and assessments, including penalties, interests <br />and other costs collected by the County on behalf of the City, shall be <br />deposited in the Unapportioned Tax Fund within the County treasury. <br /> <br /> 5. Monthly, or when reasonably practicable, the County shall pay <br />to the City 'all assessments and charges, including penalties, interest and <br />costs collected by the County for the City during the preceding month. <br /> <br /> 6. Annually, the County auditor shall furnish to the City auditor <br />a verified accounting showing the assessments and charges billed by the County <br />on behalf of the City; the amount of assessments and charges collected; the <br /> <br /> <br />
