BACKGROUND <br />In August 1997, Kaiser Sand and Gravel agreed to enter into an Indemnity Agreement <br />with the City holding Kaiser harmless for any injuries resulting from public use of the <br />Martin Avenue Buffer area. At this time, the City constructed a trail to connect Mohr <br />Avenue to the Mohr Elementary School and Amaral Park. The trail had also been <br />established in the City of Pleasanton Master Trails Plan. This 13.26 acre buffer area is <br />located on the east side Martin Avenue and is currently owned by Zone 7. The access <br />includes a paved pathway along Martin Avenue separated by a tree planter strip area <br />and unimproved trails meandering through the property. <br />This parcel is currently outside the City limits and with the concurrence of Zone 7 the City <br />is proposing annexation of this parcel into the City of Pleasanton. Following annexation, <br />the City will execute a license agreement with Zone 7 that ensures continued public <br />access to the property for trails, bicyclists and equestrians. This will also enable the City <br />to maintain the property, including landscape maintenance, waste and litter removal, and <br />weed abatement. <br />DISCUSSION <br />General Plan Issues <br />This annexation is consistent with the City's General Plan. The General Plan states that <br />the annexation of parcels of unincorporated land is critical to the effective system of <br />municipal services. The General Plan identifies the following criteria for evaluating <br />annexation proposals: <br />1. The public agencies, which provide services, should be able to serve the annexed <br />area with existing or expandable services. <br />This property will be served by the City of Pleasanton with regards <br />to park maintenance, fire, and police protection. <br />2. The proposed annexation should be a logical extension of an existing planned or <br />developed area. <br />This proposed annexation is contiguous to the city limits at the <br />easterlyright-of-way of Martin Avenue. This parcel is included in the City's <br />Master Trail Plan and is within the City's sphere-of-influence. <br />3. The quality of the development proposed for the area to be annexed should <br />enhance the existing community. <br />No development is proposed for this parcel. However, this parcel <br />has multi-use trails for pedestrians, bicyclists, and equestrians. <br />The subject annexation is contiguous to the city limits and is within the City's Urban <br />Growth Boundary. This annexation appears to be a logical expansion of the City <br />boundary and would allow control of the property for multi-use trails for pedestrians, <br />bicyclists and equestrians. <br />Page 2 of 4 <br />
