BACKGROUND <br />Tract 7399, Silver Oaks Estates (Berlogar Property), developed by Frank and Barbara <br />Berlogar, consists of a 9 lot single-family detached custom residential subdivision. Tract <br />7399 is located on the south side of Old Vineyard Avenue (Vineyard Trail) in the <br />northwest portion of the Vineyard Corridor. <br />In addition to 9single-family detached custom residential lots, Tract 7399 also created a <br />Parcel "A" and Parcel "B" open space. Parcel "B" is landscaped with Oak trees and <br />irrigated with a temporary irrigation system that will be used until the trees are <br />established. A homeowners' association will be responsible for maintaining this <br />landscaping and irrigation system, as well as the natural open space on Parcel "A". <br />Improvements (to be accepted) <br />Two new public streets were constructed as part of Tract 7399 improvements, Silver <br />Oaks Lane, an extension of Vineyard Terrace (formerly Dupont Circle) constructed with <br />Chateau Country Estates, Tract 7240 (Hahner Property), and Silver Oaks Court. Rolling <br />Hills Lane (also formerly Dupont Circle) will be extended in an easterly direction with the <br />development of the Chrisman's property. Once the Chrisman property develops, there <br />will be a continuous loop street from the Chateau Country Estates development through <br />the Silver Oaks Estates development and Chrisman property. Silver Oaks Court, when <br />extended, will serve the remaining 5 lots within Parcel 2 of Parcel Map 8070 (hillside <br />residential portion of the development). <br />The street light system, storm drain system, sanitary sewer, and the water systems <br />within the public streets serving these tracts will be maintained and operated by the City. <br />Parcel "A" and Parcel "B", the open space parcels, will be maintained by the <br />homeowners' association. The storm drainage system shown on Parcel 2 of Parcel Map <br />8070 will remain private and maintained by the property owner. <br />City Council will be accepting for formal maintenance the public improvements as <br />described above. The developer has posted the required one-year warranty bond for <br />these improvements. <br />DISCUSSION <br />Only the Berlogar portion of the loop street has been built at this time. Currently, <br />Vineyard Terrace ends at a (temporary) hammerhead turnaround constructed at the <br />common property line between the Berlogar's and Chrisman's. Since the hammerhead <br />partially extends onto the Chrisman property the Chrisman's have granted an easement <br />to the City.
