Aareement <br />NOW, THEREFORE, in consideration of the mutual promises contained herein, the <br />parties hereby agree as follows: <br />1. Recitals <br />The aforementioned recitals are true and correct. <br />2. Leased Areas <br />2.1 Description. The following areas are leased to Zone 7 by the City and Pleasanton <br />subject to the terms and conditions of this Lease Agreement: <br />2.1.1 Premises: The City leases to Zone 7, and Zone 7 leases from the City, an <br />approximately three foot by five foot (3' x 5') portion of the Property adjacent to the Tower <br />and identified in Attachment "B" ("Premises")for the installation of Equipment related to the <br />operation of the Antenna. <br />2.1.2 Antenna Site: The City and Pleasanton lease to Zone 7, and Zone 7 leases <br />from the City and Pleasanton, space on the Tower, the location of which is identified in <br />Attachment "C" ("Antenna Site"), for the placement of the Antenna. <br />2.1.3. Leased Areas: The Premises and Antenna Site shall be collectively referred <br />to in this Lease Agreement as the "Leased Areas," and Attachments "B"and "C"identifying <br />those areas are hereby incorporated into this Lease Agreement by reference as though set <br />forth in full. <br />2.2 Appurtenant Riahts. For the duration of this Lease Agreement, including any <br />extensions thereof, Zone 7 is hereby granted the following appurtenant rights: <br />(a) Anon-exclusive right of access over and across the Property from Doolan <br />Road to the Premises, and from the Premises to and across the Tower to the Antenna Site, <br />for the limited purpose of accessing, installing, maintaining, servicing, replacing, and <br />operating the Equipment and Antenna. The access areas shall be identified by the City's <br />Lease Manager and shall be the most direct pathway possible in consideration of the City's <br />construction activities and operations on the Property and the security requirements for the <br />facilities thereon; <br />(b) The right of access is limited to Zone 7, its employees, agents and <br />designated representatives, and is expressly conditioned upon Zone 7's compliance with <br />all terms and conditions of this Lease Agreement, including those set forth in section 7.2 <br />regarding clearance; <br />(c) The right of access does not grant Zone 7 any right across, over or through <br />Lease Agreement -Zone 7 Page 2 <br />
