STREET SWEEPING AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> , 19 by and between THE CITY OF PLEASANTON, a <br />municipal corporation (the "City") and [A-1 ENTERPRISES] an <br />unincorporated association (the "Contractor"). <br /> <br /> WHEREAS, the Contractor has represented that it is qualified <br />to perform and capable of performing street sweeping services <br />within the City of Pleasanton; and <br /> <br /> WHEREAS, the City desires to improve its existing service <br />level with respect to sweeping streets in the most efficient and <br />cost effective manner; and <br /> <br /> WHEREAS, the City wishes to contract with the Contractor for <br />such services; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. Contractor's Services. The Contractor shall faithfully <br />and regularly undertake street sweeping services as described in <br />this Agreement. <br /> <br /> 2. Areas to be Swept. <br /> <br /> a. Existing C~y Streets. City streets to be swept as <br /> of the date of execution of this Agreement are shown on the <br /> attached Exhibit A. <br /> <br /> (1) For purposes of calculating payment for street <br /> sweeping, it is assumed that the total length of curb <br /> miles contained in those streets shown on Exhibit A is <br /> 312 miles. "Curb miles" shall be the number of miles of <br /> each curb (or edge of pavement where no curb exists) of <br /> the City street, including median curbs and "buttoned <br /> medians" for those streets required to be swept along . <br /> medians as well as edges of pavement. The Contractor <br /> shall have sixty (60) days from the execution of this <br /> Agreement to verify the estimated curb miles of the <br /> streets shown on Exhibit A. The Contractor or the City <br /> may ask ~or an adjustment to the contract price if the <br /> actual curb miles, as verified by the Contractor and <br /> agreed to by the Director of Public Works (the <br /> "Director), varies by five percent (5%) from the <br /> estimated 312 miles. <br /> <br /> (2) Unless otherwise provided, streets shall be <br /> swept by sweeping along exterior street curbs, or edges <br /> of pavement where no curbs exist.
