City of Pleasanton <br />~ASA~r?o <br />~~.~r~~,~STAFF <br />,~~ . <br />u <br />.L ~.. .,. eru <br />~~~~~,~~EP4AT <br />'~Nry.:U <br />November 18, 1986 <br />HONORABLE CITY COUNCIL <br />Pleasanton, California <br />WA-86-2, Application of Lawrence and Victor Lund, Jr. for <br />Cancellation of Williamson Act Land Conservation Agreement for an <br />Approximately 53 Acre Site Located Generally in the Area East of <br />the Terminus of Juninero Street and San Jose Drive <br />Members of the Council: <br />Background <br />At your October 7, 1986, meeting your Council took action <br />granting tentative approval for the cancellation of the Land <br />Conservation Agreement affecting this site located in southeast <br />Pleasanton. The applicants had requested this action to be <br />processed under "regular" cancellation procedures as provided for <br />in the Government Code. Previously in 1983, a cancellation <br />request was before your Council under the "window" provisions, a <br />one-time procedure which allowed local jurisdictions to cancel <br />Williamson Act agreements pursuant to a relaxed set of findings. <br />Actions taken under this latter procedure have come under a legal <br />cloud as a result of a recent California Supreme Court decision. <br />The applicants wished to remove the cancellation action from any <br />legal uncertainty by filing the second request for cancellation. <br />Please refer to attached staff report dated October 7, 1986, for <br />additional information and discussion. <br />This application for cancellation is again before your Council at <br />the request of the applicants. Section 51283 of the Government <br />Code requires certification by the County Assessor of the full <br />cash value of the subject property for the purposes of <br />determining the cancellation fee, and that .your Council shall <br />certify to the County Auditor the amount that the landowner must <br />pay to the County Treasurer as deferred taxes upon cancellation <br />of the Land Conservation Agreement. <br />Although your Council directed, in your approval action of <br />October 7, 1986, that staff take appropriate action to determine <br />any cancellation fee and deferred taxes, the applicants' desire <br />SR86:501 <br />
