CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 86-544 <br />RESOLUTION APPROVING THE APPLICATION OF VICTOR LUND, ET <br />AL., FOR CANCELLATION OF WILLIAMSON ACT AGRICULTURAL <br />PRESERVE CONTRACT 1974-15 UNDER THE PROVISIONS OF <br />CALIFORNIA GOVERNMENT CODE SECTION 51282.1 REMOVING 53 <br />ACRES OF LAND LOCATED AT THE EASTERN TERMINI OF JUNIPERO <br />STREET AND SAN JOSE DRIVE FROM THE CONTRACT <br />WHEREAS, the City is in receipt of an application from Victor <br />Lund, et al. for cancellation of Williamson Act <br />Agricultural Preserve Contract 1974-15 under the <br />provisions of California Government Code Section 51282.1 <br />to allow development of the site for residential use <br />consistent with City General Plan policies; and <br />WHEREAS, on April 27, 1982, Council adopted Resolution No. 82-146 <br />setting forth the Williamson Act rules and procedures <br />for the City of Pleasanton; and <br />WHEREAS, based on the Initial Environmental Study indicating no <br />significant adverse effects on the environment, a <br />negative declaration was adopted by Council on <br />November 18, 1986; and <br />WHEREAS, in accordance with state and local requirements, a duly <br />noticed public hearing was held on November 18,1986; and <br />WHEREAS, Council received the City staff's report and <br />recommendation for approval of the proposed cancellation <br />of the Williamson Act contract together with facts <br />providing the bases far making the findings required by <br />law; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section l: The City Council adopts the findings stated in the <br />City staff report (SR 86:501), dated November 18, 1986, <br />entitled "WA-86-2, Application of Lawrence and Victor <br />Lund, Jr. for Cancellation of Williamson Act Land <br />Conservation Agreement for Approximately 53 Acre Site <br />Located Generally in the Area East of the Termini of <br />Junipero Street and San Jose Drive," attached hereto and <br />incorporated herein as if fully set forth. <br />Section 2: Council approves case Williamson Act 86-2, <br />cancellation of Williamson Act Agricultural Preserve <br />Contract 1974-15 under the provisions of California <br />Government Code Section 51282.1, removing 53 acres of <br />land located generally at the eastern termini of <br />
