The City Clerk is directed to transmit the initiative measure to the City <br />Attorney to prepare an impartial analysis of the measure by Friday, August 8, 2008. (As to this <br />section motion carried unanimously) <br />Section 4. Except as provided otherwise in this resolution, the City Council hereby <br />adopts the procedures set forth in California Elections Code section 9285 regarding submission <br />of rebuttal arguments. (As to this section motion carried unanimously) <br />Section 5. The City Council hereby establishes Friday, August 15, 2008 and Friday, <br />August 22, 2008, respectively, as the deadlines for submission of direct arguments and rebuttal <br />arguments for the initiative measure. These arguments must be submitted to the City Clerk by <br />5:00 p.m. on the respective deadline dates. (As to this section motion carried unanimously) <br />Section 6. The City Council authorizes Mayor Hosterman and Councilmember <br />Thorne to write a direct argument in favor of the initiative measure and gives preference and <br />priority to such argument pursuant to Elections Code §9287(a); and delegates to them the <br />selection of other persons to sign such argument. <br />Section 7. The City Council authorizes Council members McGovern and Sullivan to <br />write a direct argument against the initiative measure and gives preference and priority to such <br />argument pursuant to Elections Code §9287(a); and delegates to them the selection of other <br />persons to sign such argument. (As to this section motion carried unanimously) <br />Section 8. The City Council authorizes Council member Cook-Kallio to write the <br />rebuttal argument to the direct argument against the initiative measure and gives preference <br />and priority to such rebuttal argument pursuant to Elections Code §9287(a}; and delegates to <br />her the selection of other persons to sign such rebuttal argument. <br />Section 9. The City Council authorizes Council members McGovern and Sullivan to <br />write the rebuttal argument to the direct argument for the initiative measure and gives <br />preference and priority to such rebuttal argument pursuant to Elections Code §9287(a); and <br />delegates to them the selection of other persons to sign such rebuttal argument. (As to this <br />section motion carried unanimously) <br />Section 10. That notice of the time and place of holding the election is given and the <br />City Clerk is authorized, instructed and directed to give further or additional notice of the <br />election, in time, form and manner as required by law. (As to this section motion carried <br />unanimously) <br />Section 11. The City Council requests that the Alameda County Board of Supervisors <br />order that this election be conducted by the Alameda County Registrar's Office on November 4, <br />2008, in conjunction with the statewide General Election on that date, with the actual costs for <br />said election to be reimbursed by the City to the County. (As to this section motion carried <br />unanimously) <br />Section 12. That in all particulars not recited in this resolution, the election shall be <br />held and conducted as provided by law for holding municipal elections.
